McAlpin Tanner Marcotte Obtains Voluntary Dismissal In Cruise Line Passenger Lawsuit

A minor-plaintiff and his father sued one of the world’s premier cruise lines after the minor-plaintiff fell and broke his arm onboard a cruise ship.  The plaintiff-passengers alleged that the cruise line failed to clean up a puddle of water after an experiment in the kid’s laboratory onboard which created a dangerous condition and caused the minor-plaintiff to slip and fall. After a hard-fought discovery battle, McAlpin Tanner Marcotte disclosed surveillance video of the accident that clearly showed the plaintiff’s theory of liability was incorrect and, in fact, the cruise line had no fault in causing the minor-plaintiff’s fall. The plaintiffs filed a notice of voluntary dismissal, effectively ending the litigation.
